This website is operated by Express Matting Services Ltd., trading as Outdoor Covers UK, a company registered in England and Wales under company number 07000887, whose registered office is at Unit 1B, Summit Works, Manchester Road, Burnley, Lancashire, BB11 5HG, United Kingdom. Our VAT registration number is GB987256073.

Throughout these terms, "we", "us" and "our" refer to Express Matting Services Ltd. trading as Outdoor Covers UK. "You" means the person using this website or placing an order.

These Terms of Service, together with the policies referred to in them, set out the terms on which we supply products to you and on which you may use this website. Please read them carefully, as they contain important information about your rights and about the limits of our liability. Our Privacy Policy also applies to your use of this website.

By visiting, browsing or ordering from this website you agree to be bound by these Terms of Service. If you do not agree to them, please do not use this website.

Nothing in these terms affects your statutory rights as a consumer. Where anything in these terms conflicts with the rights the law gives you, the law prevails.

SECTION 1 – ACCESS AND YOUR ACCOUNT
By agreeing to these Terms of Service you confirm that you are at least 18 years old, or that you are using this website with the consent of a parent or guardian.

To place an order you may be asked to provide information such as your name, email address, billing address, delivery address and payment details. You confirm that the information you give us is accurate, current and complete, and that you are entitled to provide it.

If you create an account, you are responsible for keeping your login details secure and for any activity that takes place through your account. You may not transfer, sell or share your account with anyone else. Tell us immediately if you believe your account has been used without your permission.

SECTION 2 – OUR PRODUCTS
We take care to describe and picture our products accurately. However, product images are illustrative and the colour or finish you see may differ slightly depending on your screen and its settings. Sizes, weights, capacities and measurements given are approximate unless stated otherwise on the product page.

Product specifications are supplied by our manufacturers and are subject to change. We may improve, alter or discontinue any product at any time, and we may limit the quantity of any product we supply to any person, region or business.

Where a product page states a specific performance characteristic — for example a waterproof rating, a wind rating or a fire-retardancy standard — that statement applies to that product only and not to our range as a whole. If you are unsure whether a product is suitable for your intended use, please contact us before ordering.

SECTION 3 – ORDERS AND HOW A CONTRACT IS FORMED
Placing an order on this website is an offer by you to buy the products in it. It does not create a contract.

A contract between you and us is formed only when we send you an order confirmation email. We may decline an order for any reasonable cause, including where the product is out of stock, where we have identified a pricing or description error, where we are unable to obtain authorisation for your payment, or where we cannot deliver to the address you have given. If we decline or cancel your order, we will tell you and refund any payment taken in full.

Please check your order carefully before submitting it. If you need to change or cancel an order, contact us as soon as possible at sales@outdoorcoversuk.co.uk — we cannot always stop an order once it has been passed to our warehouse, but your cancellation rights in Section 6 still apply.

SECTION 4 – PRICES, VAT AND PAYMENT
All prices on this website are in pounds sterling (GBP) and include VAT at the current UK rate of 20%. Delivery is charged separately and is shown in full in your basket and at checkout before you commit to the purchase.

The price you pay is the price shown at the time you place your order and set out in your order confirmation email. We may change prices at any time, but changes will not affect orders we have already confirmed.

Occasionally a product may be listed at an incorrect price despite our best efforts. Where the error is obvious and could reasonably have been recognised by you as a mispricing, we may cancel the order and refund you in full, or contact you before dispatch to ask whether you wish to proceed at the correct price.

We accept the payment methods shown at checkout and in the site footer. Payment is taken at the time your order is placed. Details of accepted methods and payment security are set out in our Payment Policy.

SECTION 5 – DELIVERY
We deliver to United Kingdom addresses only. Delivery is charged at a flat rate of £9.99 per order. Full details of dispatch times, delivery times and how larger items are delivered are set out in our Shipping Policy.

Delivery times given on this website are estimates. We are not responsible for delays caused by carriers, weather, or other events outside our reasonable control, but we will keep you informed and help you trace a delayed order.

Goods become your responsibility when they are delivered to the address you gave us. If you have asked for delivery to a nominated safe place or a third party, they become your responsibility at the point they are left there.

If we fail to deliver within 30 days of the contract, or within any longer period we have agreed with you, you may treat the contract as at an end and receive a full refund.

SECTION 6 – CANCELLATION, RETURNS AND FAULTY GOODS
If you are a consumer, you have a legal right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel your order within 14 days of receiving the goods, without giving a reason. Our Cancellation Policy explains how to do this and how your refund is calculated.

Under the Consumer Rights Act 2015, the goods we supply must be of satisfactory quality, fit for purpose and as described. If they are not, you may be entitled to a repair, a replacement, or a refund. Our Refund Policy explains how to make a claim.

Some goods are excluded from the 14-day cancellation right by law — in particular goods made or cut to your specification or clearly personalised. This does not affect your rights if such goods are faulty or not as described.

If you are buying as a business rather than as a consumer, the statutory cancellation right in this section does not apply, and returns are accepted at our discretion under our Refund Policy.

SECTION 7 – INTELLECTUAL PROPERTY
This website and its content — including text, product descriptions, images, graphics, page layouts, and the selection and arrangement of them — are owned by Express Matting Services Ltd. or used by us under licence, and are protected by copyright, trade mark and other intellectual property laws of England and Wales and, where applicable, of other countries.

You may view, download and print pages from this website for your own personal or internal business use. You may not reproduce, republish, distribute, modify, sell or exploit any part of this website commercially without our prior written permission.

"Outdoor Covers UK" and our logos are trade marks of Express Matting Services Ltd. Manufacturer brand names, product names and images shown on this website are the property of their respective owners and are used to identify the products we sell. "Shopify" and Shopify's logos are trade marks of Shopify Inc.

SECTION 8 – OPTIONAL THIRD-PARTY TOOLS
This website may give you access to tools provided by third parties which we neither control nor monitor. Those tools are provided "as is" and "as available", without warranties or endorsement of any kind, and any use you make of them is at your own risk. You should read and be satisfied with the third party's own terms before using their tools. We may add new features and tools to this website from time to time; they will also be covered by these terms.

SECTION 9 – THIRD-PARTY LINKS
This website may link to websites operated by third parties. We do not control those websites and are not responsible for their content, accuracy, security or privacy practices. Following such a link is at your own risk, and any purchase you make from a third party is a contract between you and that third party. Complaints or questions about third-party products or services should be directed to that third party.

SECTION 10 – RELATIONSHIP WITH SHOPIFY
Outdoor Covers UK is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Outdoor Covers UK. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Outdoor Covers UK, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Outdoor Covers UK.

SECTION 11 – PRIVACY AND YOUR PERSONAL DATA
Express Matting Services Ltd. is the data controller for personal data collected through this website. How we collect, use, share and store your personal data, and the rights you have over it, are set out in our Privacy Policy. Please read it before using this website.

Because this website is hosted by Shopify, Shopify also collects and processes information about your use of the site in order to provide and improve the service. Some of that information may be transferred to and processed in countries outside the United Kingdom. Shopify's own privacy notice is available at shopify.com/legal/privacy/app-users.

SECTION 12 – REVIEWS AND FEEDBACK
If you send us ideas, suggestions, reviews, photographs or other material ("Feedback"), you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish and display it in connection with our business, including in our marketing.

You confirm that any Feedback you send is your own, that you have the right to send it, that it is honest and based on genuine experience, and that it does not infringe anyone else's rights or contain anything unlawful, offensive or misleading. We are not obliged to publish, keep confidential, pay for or respond to Feedback, and we may remove Feedback that breaches these terms.

SECTION 13 – ERRORS, INACCURACIES AND OMISSIONS
Occasionally information on this website may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, delivery charges, transit times or availability. We reserve the right to correct any such error and to update information at any time without prior notice. Where an error affects an order you have already placed, we will contact you before dispatch and give you the choice of proceeding at the corrected terms or cancelling for a full refund.

SECTION 14 – PROHIBITED USES
You may use this website only for lawful purposes. You must not use it: for any unlawful, fraudulent or malicious purpose; to breach any applicable law or regulation; to infringe our intellectual property rights or those of anyone else; to harass, abuse, defame or harm any person, including our staff; to transmit false or misleading information; to send unsolicited advertising or spam; to impersonate any person or organisation; or in any way that restricts anyone else's use and enjoyment of the website.

You must also not knowingly introduce viruses or other malicious code; copy, resell or exploit any part of this website; harvest personal data of others; scrape, crawl or spider the site other than as a legitimate search engine; or attempt to circumvent its security features. We may suspend or terminate your access if we reasonably believe you have breached this section.

SECTION 15 – SUSPENSION AND TERMINATION
We may suspend, withdraw or restrict all or part of this website for business or operational reasons, and we will give you reasonable notice where we can. We may end your access to your account if you seriously or repeatedly breach these terms. Ending your access does not affect any order already confirmed, or any amounts you already owe us.

Sections dealing with intellectual property, feedback, limitation of liability, governing law, and any other provision intended to survive, will continue to apply after termination.

SECTION 16 – DISCLAIMER
The general information on this website — such as guidance articles, sizing advice and product comparisons — is provided for general information only and is not professional advice. You should satisfy yourself that a product is suitable for your intended use, and seek professional advice where the use is structural, commercial or safety-critical.

We do not guarantee that this website will always be available, uninterrupted or free from errors, and we may change or update its content at any time.

Nothing in this section limits the statutory rights you have as a consumer in relation to the products we sell you, including that they must be of satisfactory quality, fit for purpose and as described.

SECTION 17 – OUR LIABILITY TO YOU
We do not exclude or limit our liability to you in any way where it would be unlawful to do so. This includes our liability for death or personal injury caused by our negligence; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products, including the right to receive products which are of satisfactory quality, fit for purpose, as described and supplied with reasonable skill and care; and under section 2(3) of the Consumer Protection Act 1987.

If you are a consumer: we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen, or if at the time the contract was made both we and you knew it might happen. We are not responsible for loss or damage that is not foreseeable. We supply our products for domestic and private use unless the product page states otherwise; if you use a product for any commercial or business purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.

If you are a business: subject to the first paragraph of this section, our total liability to you for all claims arising out of or in connection with a contract, whether in contract, tort (including negligence), breach of statutory duty or otherwise, is limited to the price you paid for the products concerned; and we are not liable for loss of profit, loss of business, loss of contracts, loss of goodwill, business interruption, or any indirect or consequential loss.

SECTION 18 – INDEMNITY (BUSINESS CUSTOMERS ONLY)
If you use this website in the course of a business, you agree to indemnify us against any losses, damages, liabilities and reasonable legal costs we incur as a result of your breach of these terms, your breach of any law, or your infringement of the rights of a third party. This section does not apply to consumers.

SECTION 19 – EVENTS OUTSIDE OUR CONTROL
We are not liable for any failure or delay in performing our obligations that is caused by an event outside our reasonable control, including strikes, carrier failure, fire, flood, severe weather, epidemic, failure of public or private telecommunications networks, or acts of government. If such an event occurs we will contact you as soon as possible, and if the delay is substantial you may contact us to end the contract and receive a refund for any products you have paid for but not received.

SECTION 20 – SEVERABILITY, WAIVER AND ENTIRE AGREEMENT
If any provision of these terms is found to be unlawful, void or unenforceable, that provision will be severed and the remaining provisions will continue in full force.

If we delay in enforcing any of these terms, or do not enforce them at a particular time, that does not mean we have given up our right to do so later.

These Terms of Service, together with the policies referred to in them, form the entire agreement between you and us in relation to your use of this website and any products you buy from it.

SECTION 21 – TRANSFERRING THIS AGREEMENT
You may not transfer or assign your rights or obligations under these terms without our written consent. We may transfer our rights and obligations to another organisation, and we will tell you in writing if this happens; if you are a consumer and you are unhappy with the transfer, you may contact us to end the contract within 14 days and we will refund you for any products you have paid for but not received.

SECTION 22 – GOVERNING LAW AND JURISDICTION
These Terms of Service, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the law of England and Wales.

You and we both agree that the courts of England and Wales have non-exclusive jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in the courts of the part of the United Kingdom in which you live.

SECTION 23 – CHANGES TO THESE TERMS
The current version of these Terms of Service is always available on this page. We may update them from time to time to reflect changes in our business, our products or the law. Any change will apply to orders placed after the change is published. We will give you reasonable notice of material changes where the law requires it.

SECTION 24 – COMPLAINTS AND CONTACT
If something has gone wrong, please contact us first with your order number and we will do our best to put it right. We aim to acknowledge complaints promptly and resolve them within 14 days.
